A US federal judge on Monday refused to block a land exchange that hands SpaceX more than 700 acres (280 hectares) of the Lower Rio Grande Valley National Wildlife Refuge in Texas, according to the Associated Press (AP).

Judge Fernando Rodriguez Jr. of the US District Court for the Southern District of Texas, nominated by Donald Trump in his first term, said the plaintiffs offered ‘relatively weak’ evidence of environmental harm and that an injunction would set back the company’s plans. SpaceX surrenders 683 acres (276 hectares) it bought in Cameron County. The US Fish and Wildlife Service (FWS) approved the exchange in June in a finding that concluded it would cause no significant impact. The suit was filed by the Center for Biological Diversity and the Carrizo/Comecrudo Nation of Texas, which said they will keep litigating; spokesperson Laiken Jordahl said the swap amounts to handing public land to the company and clears the way for bulldozers in the refuge. The administration is weighing a similar swap of land in Yosemite National Park in California.
